Numerous assault weapons charges were dismissed against Jeffrey Scott Kirschenmann after the court granted a motion filed by H.A. Sala to traverse and quash the warrant to search Kirschenmann’s residence. During the hearing on the motion, that could have statewide ramifications, the court ruled the evidence seized is inadmissible because Department of Justice agents intentionally misrepresented facts in the warrant affidavit.
